Ordinance Amending Article IV, Section 9, Subsection .060(B), of the South Wilmington Municipal Code Regulating Rubbish Burning Within the Village of South Wilmington.
.060(B) Rubbish Burning: It is unlawful to burn wet cardboard or paper, rags, feathers, wet or green leaves, green weeds or grass at any time. The burning of any material such as rubber tires, leather, tar paper, old batteries, or any material which emits offensive odor when burned is unlawful within village limits. Limited amounts of paper cardboard, dry leaves or other combustible material may be burned as long as the material is dry and does not create an offensive odor, nuisance, or fire hazard due to excessive high winds. Combustible material may not be burned between the hours of 9:00 a.m. and 5:00 p.m. Monday through Friday during the months of March through October. The continued smoldering of slow burning combustible waste within the prohibited timeframe contained herein is a nuisance, and anyone kindling such a fire which be considered performing an unlawful act.
